Processing your personal data

Kellve Sweden AB corp. ID no. 556770–2278 (”the Company” or ”we”) has the policy of taking all necessary measures to ensure that personal data concerning our customers and suppliers is processed by us legally, correctly and openly.

When you use our various services, we collect your personal data. The Company is thus the personal data controller for your personal data and processes it in accordance with this privacy policy. The privacy policy explains and clarifies your rights in relation to the Company regarding the processing of your personal data and how you can exercise your rights.

The Company is committed to protecting your personal data and ensuring that your personal data is always processed securely. We comply with all existing applicable laws and rules to protect the privacy of individuals, including the Personal Data Act (1998:204) (PUL), the Electronic Communications Act (2003:389) and such other regulations that implement the EU Data Protection Directive 95/46/EC, the Privacy and Electronic Communications Directive 2002/58/EC, and the EU General Data Protection Regulation 2016/679 (GDPR), as well as any amendments, additions or regulations that replace such laws, statutes, regulations and rules. We use appropriate and reasonable physical, technical and organizational security measures in relation to the amount and sensitivity of personal data.

What personal data do we collect and from where?

If you request a quotation from Kellve Sweden or order goods/services from Kellve Sweden, you may provide information to us that is considered to be personal data under applicable data protection laws.

Depending on the context, the types of personal data that we collect may include:

  • name and contact information including address, mobile number and e-mail address
  • personal identity number
  • delivery and invoicing information, payment information and other information that you provide in connection with purchase or delivery of a product or service
  • other information that is relevant for customer surveys, advertisements or offers

We may collect your personal data from the following sources:

  • when you contact us via e-mail or phone
  • through agreement, invoice or other business contact, if you are a contact person for any of our contractual partners

Why do we process your personal data?

If you have ordered a product or a service, you have entered into a contract with the Company, and we therefore process your personal data in order to administer your purchase or your order as well as to enable delivery of the service or product you have ordered.

In addition to processing your personal data to complete the purchase of goods and services, the Company may use your personal data for other purposes, based on other legal grounds, as set out below.

  • To fulfil an agreement: For handling and administration of purchases, delivery of goods, to make payments.
  • Consent: Newsletter.
  • To fulfil a legal obligation: We save invoice documentation in accordance with applicable accounting rules.
  • Legitimate interest: In order for us to be able to provide, implement and improve our commitments, products and services, it is necessary for us to process personal data in certain other cases as well, e.g. when analysing our customers’ buying patterns with the aim of providing them with relevant information and marketing, as well as for statistical purposes.

In the event that a service we provide requires your consent, we will always explicitly ask you to give your consent to such a service and to us processing your personal data in such a case.

By giving your consent, you will receive confirmation that you have read this privacy policy and that you agree to your data being processed as described herein.

Retention of personal data

The Company takes all reasonable steps to ensure that your personal data is processed and stored securely. Your personal data will never be stored for longer than permitted by applicable law or longer than is necessary to fulfil the purposes stated above. Your personal data will be processed by us during the following time periods.

  • To fulfil an agreement: Personal information (name, personal identity number, address, telephone number, e‐mail, billing and delivery information) provided in connection with ordering products or services is stored for as long as required for the Company to be able to fulfil its agreement with you. This includes fulfilling delivery or warranty undertakings.
  • Legal obligation: The Company saves such data that constitutes accounting information in accordance with applicable accounting rules.
  • Consent: In cases where we process your personal data based on your consent, we will only save your personal data for as long as we have your consent.

Transfer of personal data

Information about our customers is an important part of the Company’s operations. [and we do not sell the information to anyone else]. We always exercise the utmost care when transferring your personal information and your personal data is never passed on without the support of this privacy policy and appropriate security measures being taken.

  • Matching with private and public records: The Company may supplement your personal data with further information by obtaining information from other private and public records, for example, the Swedish State Personal Address Register (SPAR), Bisnode Sverige AB. Your personal data may be supplemented and updated in this way.
  • Corporate transactions: If all or parts of the Company’s operations are sold or integrated with other operations, your personal data may be disclosed to our advisers, potential buyers and their advisers, and passed on to the new owners of the business.
  • Legal obligations: Your personal data may also be disclosed in order for the Company to fulfil certain legal obligations and may be handed over to the police and other relevant public authorities when permitted and required by law.

Transfers as mentioned above may only be made to companies within the EU or EEA (i.e. all EU member states as well as Iceland, Norway and Lichtenstein). We do not process any personal data outside the EU and EES.

Withdrawal of consent

In cases where we process your personal data based on your consent, e.g. regarding subscription to newsletters, you may revoke your consent at any time by contacting the Company as described below. Such revocation may be made in whole or in part. If you do not wish to receive marketing and advertising offers from us you can revoke your consent by contacting the Company. If you revoke your consent to the use or disclosure of your personal data for other purposes stated in this privacy policy, we may no longer be able to continue to give you access to our websites or provide customer service or other services offered to our users and permitted under this privacy policy.

Your rights

You have the right to request information about what personal data we have registered concerning you and how it is being used after a written application has been submitted to us according to the contact information below. You can change your personal information at any time by contacting the Company as below. You are also entitled to contact the Company to request that personal information about you be corrected if it is incorrect, incomplete or misleading. To protect your privacy and your personal data, we may require that you identify yourself in connection with our assistance.

In accordance with applicable personal data legislation, you also have the right to request that your personal data be deleted or that the processing of your personal data be restricted. In certain cases you also have the right to object to the processing of your personal data and request that your personal data be transferred in electronic format.

You can lodge a complaint with the Swedish Authority for Privacy Protection if you believe that the Company’s processing of your personal data is not carried out in accordance with applicable law.

Cookies

The Company uses so‐called cookies on our websites. A cookie is a small text file sent from a website to your web browser. The cookie cannot identify you personally, only the web browser that is installed on your computer and the web browser you use when visiting the web page. Consequently, different cookies are saved on different computers, should you use different computers when visiting our websites. Cookies do not carry viruses and cannot destroy other information stored on your computer.

Changes to the privacy policy

Please note that the terms of the privacy policy may be amended. Any new version will be published on the Company’s websites. You should therefore periodically review these terms to make sure that you are satisfied with the changes.

If the changes concern such data processing that we carry out based on your consent, we will give you the opportunity to give your consent again.
